We thank you for choosing us for the best travel experience. We take all possible efforts to make sure that you have a great holiday experience. We pay every attention to the all details of your vacation. However, we also request you to read the Terms and Conditions. When you use our services and the website, you must give your unconditional consent to these terms and conditions. Kindly refrain from using this site if you do not agree with any Terms and Conditions.

Description:

  • These Terms and Conditions will be called and termed as Explore World Holidays (Domestic and International Tours and Tourist) Terms and Conditions.
  • Explore World Holidays will be hereinafter referred as “Explore World”, “we”, “us”, “our” “the Company”, and its users and customers will be hereinafter referred as “client/s”, “travelers”, “tourists”, “Guest”, “them”, “you”, “your” etc. and not limited up to these.  
  • Terms & Conditions are applicable to all Domestic as well as International Tours, Customized Holidays and all types of holidays and services offered by us.  
  • By using our website and all our services, you confirm your consent to the website’s terms of use, and you undertake to comply with them.

Definitions: -

Hotelier or hotel owner/s, hotel management companies, owner/s of any airlines or shipping company or railway, ferry boat owner, bus and coach owner, or any other person or organization which has been selected to render services to the users are "Independent Contractors".

"Outbound Tour" means a tour operated and /or arranged by us outside of India and includes, but is not limited to, regular tours, special tours, brochure tours, holiday packages, cruise, sightseeing, carnival, fixed departure tours etc.

"Tour Cost" or “Tour Price” means total cost of the bookings for all the services booked by the User for the tour.

"Booking Fees" or “Advance amount” means a non-refundable fee or any token money paid and/or deposited at the time of booking by the User.

"Brochure" means catalogue, email, flyer, or any other document that contains the information about the tour, its itinerary and inclusions/exclusions.

"Infant" means a child below the age of 2 years at the time of completion of travel and child means a person above the age of 2 years and below the age of 12 years at the time of completion of travel.


ROLE OF EXPLORE WORLD HOLIDAYS AND LIMITATION OF LIABILITY

We do not control or operate any airline, train service, ships, coach, cars, transport vehicles, hotel, restaurant, kitchen van, caravan or any other facility or service mentioned in our tour packages.

We shall not be responsible for any delay, improper and/or short service, standard of service provided by any service provider or any Independent Contractor. We shall not be responsible for any injury, death, loss or damage which is caused by the act or default of any hotel, airlines, shipping companies, cruise, coach and/car owners and/or drivers, tour operators who are independent contractors.

We shall not be responsible for any act or actions of co-passengers and other people present which may result in injury, damage to the life or limb or property of the User, or which may lead to interference in enjoying or availing the services provided during the tour.

We are merely a facilitator and shall not be liable for the following:

  • Sickness, diseases, injury, accident, death, loss of any type, delay, discomfort, additional expenses, personal expenses, incidental and/or consequential loss and/or damage of any type and/or theft caused to the User or any person travelling with them.
  • Any default, act, omission of any contractor, travel agent or third party or any other person employed by them and/or representing them, who may have been engaged in the arrangements of tour, providing accommodation, refreshment, transport and carriage facility or any other service for the User or for any person traveling with him /her.
  • Temporary or permanent baggage, damage to the baggage and personal belongings caused due to any reason including negligence on the part of any person.
  • Any delay in delivery of the services by the concerned service providers and contractors.
  • Failure of the airline to accommodate passengers despite having confirmed tickets for any reason whatsoever including rescheduling, cancellations, route change, operational reason, overbooking etc. 
  • Failure of the hotel to allow check-in despite confirmed booking for any reason.
  • Any claims due to the dispute with the tour manager and co-passengers.
  • Any claim arising due to delay at the airport and if the User has to wait at the airport or at the hotel for check-in due to any reason not attributable to us. We shall not be liable for making any additional arrangements, including but not limited to travel, food, accommodation in case of such delays.
  • Any damages caused to the User due to reasons beyond our control.
  • In no event shall the entire liability of Explore World Holidays for any direct or indirect claims arising out of the tour exceeding the total booking amount paid by the User.
  • There can be exceptional circumstances where the service operators like the airlines, hotels, transport providers or any other contractors are unable to honor the confirmed bookings due to various reasons like weather conditions, rains, natural calamities, epidemics and pandemics, unrest, riots, political reasons, insolvency, business exigencies, government decisions and directives, operational and technical issues, route change, flight cancellations etc. If we are informed in advance of such situations where dishonor of bookings may happen, we will make its best efforts to provide similar alternative arrangements to the User or refund the eligible booking amount after reasonable service charges and cancellation charges, if supported and refunded by that respective service operators. The User agrees that we being the facilitators, we shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. Our maximum liability in such events will be to refund the booking amount subject to receipt from the service providers.
